NYS DOH Advisory: Electronic Prescribing Mandate Exceptions

On March 14, 2022, The New York State Department of Health (NYS DOH) issued an advisory informing practitioners and pharmacists of a blanket waiver of the electronic prescribing requirements of Public Health Law § 281 and Education Law § 6810 for certain exceptional circumstances in which electronic prescribing cannot be performed due to limitations in software functionality.

While a new version of the standard has been adopted by the Center for Medicare and Medicaid Services, the NYS DOH recognizes that practitioners will need time to transition and implement this standard. The new version will address both the limited characters in prescription directions and compounded prescriptions.
