In Focus – Family Practice Malpractice Claims
It is not surprising, given the nature of the work of family physicians, according to a Medscape Survey in 2015, failure to diagnose is the top allegation for this specialty. This was followed by patient suffering an abnormal injury, failure to treat, errors in medication administration, and poor documentation of patient instruction and patient education. (1) Although by age 54, more than 50% of PCPs (54%) had experienced at least one malpractice suit, the Medscape Survey (2015) shows that PCPs are at less risk of being sued compared to their peers in other specialties. (2)
Family physicians (PCP) are in an opportune place as a specialty, to establish strong relationships with both patient and family alike. When there is an unexpected outcome in clinical care, research shows that patients and families are less inclined to bring a lawsuit against a physician that they like. It is easier to sue a physician when there is no relationship established and from a family perspective even easier to sue a physician the family has never met.
